Banning porn on television would be “unconstitutional” – TopTV

TopTV has told the Independent Communications Authority of South Africa (ICASA) it would be “unconstitutional” to prevent it from broadcasting porn.

HumanIPO reported earlier today TopTV’s parent company, On Digital Media (ODM), was in discussions with a potential investor, but the broadcaster is currently engaged in a public hearing to determine whether it can roll out three adult channels.

Advocate Steven Budlender, representing TopTV at ICASA’s office in Sandton, told the hearing: “It does not matter what I, the ICASA council, any political party of any other organisation think about pornography on TopTV.

“ICASA, by law, does not have the power to refuse TopTV a licence. In fact, it will actually be unconstitutional if consent is withheld.”

Dr Albu van Eeden, of Doctors for Life, said watching porn is “one of the most addictive habits” and releases a similar substance in the brain to cocaine, LSD and morphine.
