Court orders MTN Ghana to stop World Cup promotion

An Accra circuit court has ordered MTN to halt its MTN GO RIO promotion, through which the operator planned to reward customers during the forthcoming Brazil 2014 World Cup.

The interim injunction was granted to restrain MTN from going ahead with the promotion after Ghana’s National Lottery Authority (NLA) brought an application before the court.

The NLA is asking the court to declare the promotion not consumer or marketing promotion but a lottery, as prohibited by section 4(1) of the National Lotto Act, 2006.

It also wants the court to declare the promotion has all the attributes and elements of a lottery under the laws of Ghana, being the existence of a prize to be won through the draw or chance after spending a little more on voice, data or SMS than usual.

The NLA is asking the court for a perpetual injunction restraining the defendant, its agents, assigns, privies, and workmen from sponsoring, promoting, conducting, or advertising the promotion.
